Now there is a large difference! I don't remember YouTube saying that they hold the rights to edit, distribute, or exploit your videos.
I joined EMUSE just for shits, but I wouldn't upload any of my own hard work to the site, since by signing up you give up ALL rights to your content (but... you still own copyrights to it:uhoh: ).
The joining terms of use specifically say that they could edit your content. That would most definitely include the removal of your logos, name imprints, and credits to any video you personally make. YES THEY WOULD BE ABLE TO LEGALLY DO THAT!
My advise to anyone using this new program would be.... fucking post videos you didn't work hard to create or those owned by others!:bigwink:

Meh, that stuff is simply in there for times where we would make a compilation video or if it needed to be sped up for a better user experience or if it needed to be formatted for TV or another type of media...You will find the same legalese on ANY content release form...
We love to give credit to authors whenever possible and have no problem doing so.
My adviCe to anyone out there is to not listen to TORCH for legal counsel.

Jay, of course you're encouraging everyone not to listen to Torch for legal counsel... mostly since his advice to uploading users means a direct transition of material to YouTube.com or other sites. You, as a staff member of EBW, would be an idiot to support that.
Anyways, whatever your reasons for allowing uploading users to "volountarily" waive their rights, YouTube.com allows users to upload freely without concern of exploitation while EbaumsWorld.com fails to provide these same protections.
I understand that no member of EBW is going to agree with me but, to me, "Jay's jargon" sounds somewhat like this:
"Better user experience" = More money
"Formatted for other mediums" = More ways to make money
As for comparing legalese, this is about as simplified as it gets. These are excerpts from each of the "Terms of Use" pages on EbaumsWorld and YouTube, respectively:
Ebaumsworld.com:
"You hereby irrevocably grant, transfer and convey to us the unlimited and unconditional right to distribute, exploit and use... any materials, videos, sound recordings, compositions, pictures, song lyrics and/or other content (collectively, the .Content.) submitted by you to us."
YouTube.com:
"The content on the YouTube Website, except all User Submissions... are owned by or licensed to YouTube."
"Same legalese", eh? Surprise!
Now tell me Jay... are you really EBW staff member, or actually a public relations/EBW propagandist in disguise?

I'm far from stating that YouTube is a benevolent media-sharing site that wants the best for everyone; it is very much the opposite. However, I'm comparing differences in the styles to which each organisation approaches copyright protection for uploading users. YouTube p-r-o-t-e-c-t-s uploaders; Ebaumsworld e-x-p-l-o-i-t-s them.

Once again, as you should have been able to tell from my position, I am choosing NOT to upload videos to Ebaumsworld, hence the difficulty. However, for purposes of comparing each site in terms of accessibility to legal information, YouTube has it available to whoever wants to see it. This is, however, a side note and irrelevant to the point of the thread.

Hate to break it to ya but comparing excerpts proves nothing (especially the 2 you picked, its like apples and oranges, its almost like you took the first line from each??? They have nothing to do with eachother.). If you read through the full YouTube terms you'll find many, if not all of the exact same things you quote from ours.
It's quite simple really. This gives them (and us) the right to showcase uploaded videos on TV, in magazines, newspapers, books, or other types of media. How do you think YouTube gets away with that weekly (or is it daily?) segment on the Today Show? Or on cellphones with Verizon? Or the countless other partnerships they have with media companies around the world?
And to top it off, our terms specifically state that the owner of the content retains ALL ownership rights to the content:
"2. Ownership of Content: You retain full ownership of and all right, title, and interest in and to the Content, including any related copyrights, subject to the rights granted to us under this agreement."
As for accessibility, click Submit Content, then click "Terms of Use", doesn't get much easier than that....?

You are kidding youself if you think google doesn't make money off youtube. The goal is to draw as many eyeballs as possible and then sell ads by google. They are making billions of dollars a year and youtube is huge to thier bottom line. They just make it look like it's all about the users. At least ebaums is honest.
