My friend got pulled over and ticketed for 55 in a 35. He claims that he was in a 50mph speed limit zone. The other side of the road's speed limit was 50mph, but the side he was on did not have a sign for a speed limit in the current spot he was trapped at. The closest one was about a half mile back where the speed limit is 35. The side he was on had a 50mph speed limit sign, but he did not reach it yet, it was about 500feet up the road from him.

Basically my question is that just because one side of the road has a speed limit of 50, does that mean that the other side is 50 as well, or can they be different? If he were in the same spot going the other direction going 55, he would not have been pulled over. Is there a way he can fight it and win?

Was there a barrier in the middle seperating the sides of the street? If not, then the speed limit is the same for both sides.

Can't fight it and win, but you can fight it and get the ticket reduced. Just explain your story, take pictures of where you were pulled over, and tell the magestrate or whoever you appear before the story, and that's it.

Then tell your friend to stop speeding.

Thats what I thought too, thanks. There was just a double yellow between the lanes.

I dont think thats true...

Becasue there is a road here on one side it says 30MPH and on the other it says 35MPH and the signs are almost across from each other and they're only seperated by double yellow.

Maybe b/c this is florida and the rules of the road suck...

There's a road here that's 25 MPH on one side and 35 MPH on the other but the two sides are separated by a barrier.

yeah, but how he's describing it is, 2 speed limits on a single section of road.

What you guys are describing is a changing speed limit. If you're leaving a 35 mph zone, and entering a 30mph zone, then the traffic on the other side of the street is leaving the 30mph zone, and entering the 35mph zone that you were just in. It's common to have 2 different speed limit signs directly across the street from one another, but I've never seen 2 different speeds for one particular length of road.

Yeah pretty much nothing you can do...
i actually just paid my speeding ticket today: $120.50 for doing 48 in 30 it was orig. $250.00 but i talked him into lowering it quite refreshing actually now i have to go to a school and get the 3 points off license...

i was only speeding to pass and old guy but kept going a little bit

Tell them you'll take a Defensive Driving Class. After that they will drop the charges because you'll pay for the Class (money into the transportation system) and it won't show up on your driving record. This will save you lots of cash when it comes to insurance payments in the future.

i was only speeding to pass and old guy but kept going a little bit

He was going 55 cause he thought he was in a 50.
