View Full Version : Help! Need Prank Info From a Pro! Asap.

I been doing prank calls for quite awhile. Me and my 3 buddies did them just for giggles, then we started recording them to the PC. But one of my buddies decided to put them on CD, hes not selling them, but he gave them out to a bunch of people, now im worried word will get around, and it will all come back to me cause its all me..my voice..on these CD's. If im not making a profit off of these calls, theres no way I can get in trouble right? I know its "rare" for the persons I pranked to hear these calls, but if they do..The other party cant do anything in a one consent state right? Someone let me know So I can get this off of My chest. Thanks much!

In the United States, the Telecommunications Act of 1996 makes some prank calls a felony with penalties of up to two years in prison, and possible fines (depending on severity). However, such penalties are rarely carried out. As an example, the Chicago shock jock Erich "Mancow" Muller, after being criticized for the extensive use of prank calls on his radio show, broadcasted the sarcastic remark: "Reality check for you people: Chicago's the murder capital of America. The police don't care if you get a prank call."
Moreover, to make a prank call that falls afoul of the Telecommunications Act, 47 U.S.C. § 223 (a)(1), the call must be done with the intent to "annoy, abuse, threaten, or harass". Arguably then, if the intent of the call is to amuse, confuse, or simply to engage the call's recipient, there is no violation of the Telecommunications Act.

I know the pranking wont get me in trouble haha. But the fact theres recordings of them out there of me and my actual voice on CD..is the rules different then? Someone said along the lines as long as youre not making money off of them, theres really no worry, but it does break a privacy act?
(yes I know its rare for it all to come to this haha but I'm talking worse case scenario here lol)

Worst case scenario: Someone actually someone traces it back to you, and in some rediculous way you may be facing some sort of penalty because of this, all you have to do is say that you did not make the calls and it just sounds like you

Yeah, I know nothing will ammount to it, but I was just thinking, cause Laws and Privacy acts I never delt with..I'm sure hardly anyone online with pranks has release forms haha.

because cops have better thing to do then look for prank callers
if u dident record music on the cd's ur fine. the selling part is shit.
