A couple whose medical-marijuana plants were seized are threatening to sue authorities because the plants were returned dead.

The police seized 39 live marijuana plants from Jim and Lisa Masters in August 2006 and arrested them on drug charges, said their lawyer, Brian Vicente. The couple said they were using the plants for medical purposes and providing marijuana to several patients who were licensed to get it.

The narcotics charges against the Masters were dropped in June, and the plants were returned to them Monday, but dead.

The plants might be worth more than $100,000, the couple's attorneys told the Coloradoan newspaper.

The department didn't have to care for the plants because the couple did not have documentation to show the plants were legal, police spokeswoman Rita Davis said.

Yeah I think there was a thread in C/E some time ago. At least I think it was in here...anyway, yeah, he's dead. It made me sad :(

Yeah, I was helping a buddy with a license get a growing rig get set up. He told me all about this kind of crap. That "documentation" they're talking about? That's a county-regulated system. You go down to your local police department and show your ID's and they will sell you a little tag with a number on it. You attach the tag to your plant and it will be exempt from seizure. The price of each tag? Upwards of $50 each, per year. This, obviously, is an example of Uncle Sam wanting a piece of the pie more than anything else.

And yes, those plants probably could have been worth other $100,000. I hope they get their money back in court.

Yeah, it's bullshit. If the police took their puppies and returned them dead, they would be held liable, so what's the difference?

I disagree. If the police took their puppies they would turn them over to animal control and they would be taken care of, if they took children they would be turned over to CPS and they would be taken care of...why in the world would the police have, and more to the point why would the tax payers pay for the police to have the equipment and resources to take care of confiscated marijuana plants. It is ludicrous to expect that. If the people had the documentation that they were supposed to have they would not have had this problem and they were lucky they got anything back. They could have disposed of them altogether.

I kill myself growing tomatos in my backyard every year and all I get out of the deal are some nice salads and BLTs.

The point is, they were in posession of a plant in which they were legally entitled to have. The police department wrongly confiscated the plants, and now they are dead. I don't see how the police are not liable. and 9/10 times I side with the police. Especially when they beat blacks. Then it's 11/10 times. But this is crossing the line.

If I get pulled over without my CHL the police will confiscate my weapon and arrest me. These people didn't have their documentation, therefore the police were well within their rights to arrest the people and confiscate the plants. It isn;t like they purposely killed the plants, they simply do not have the resources to keep them alive, and why in the hell should they.
